1. About Canary

Canary ("we", "us", "our") is a home health monitoring app that helps users identify potential health and safety risks in household products using AI-powered image analysis.

These Terms of Use govern your use of the Canary mobile application and any related services (collectively, the "Service").

2. Not Medical Advice

Canary is not a medical device and does not provide medical advice. Scan results, health scores, and product information are for general informational purposes only and should not be relied upon as a substitute for professional medical, health, or safety advice. Always consult a qualified professional for health concerns.

The information provided by Canary is based on publicly available research and AI analysis. Results may be incomplete, inaccurate, or outdated. We make no warranties about the accuracy or completeness of any scan results.

You must be at least 13 years old to use Canary. By using the Service, you confirm that you meet this requirement. If you are under 18, you must have permission from a parent or guardian.

When you submit photos to Canary for analysis, you grant us a limited, non-exclusive licence to process those images solely for the purpose of providing the scan result. Photos are not stored on our servers and are discarded after analysis. You retain full ownership of any content you submit.

8. Intellectual Property

All content, features, and functionality of the Canary app — including the app design, text, graphics, icons, and software — are the exclusive property of Canary and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the app without our written permission.

10. Affiliate Links

Some product recommendations within the app include Amazon affiliate links (tag: canaryapp-20). If you purchase through these links, we may earn a small commission at no additional cost to you. Affiliate relationships do not influence our health assessments or recommendations.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any scan result or recommendation.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Canary and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to health decisions made based on scan results. Our total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

You agree to indemnify and hold harmless Canary and its operators from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Ontario, Canada.

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.
